These are our promises to you
- The software is SMOC — a proactive AI sales system (agents, flows, Console, Studio, Bot runtime, and outreach). We may change, improve, or retire features.
- What you see on the website is what you pay. We can change those levels with 30 days’ notice. You can leave whenever you want.
- You decide how you use SMOC. We do not take responsibility for your campaigns, content, targeting, or results.
- Your customers’ data stays yours. We process it to run the service. Details are in the Privacy Policy.
If a signed order, statement of work, or custom credit contract says something else, that document wins where it conflicts with these terms (typical for Enterprise).
Questions: [email protected].
1. What SMOC is
SMOC is software for proactive AI sales. Agents start and steer conversations, qualify intent, and hand off CRM-ready outcomes across channels — web, ads, and message-style flows.
These terms cover the SMOC services you access, including:
- www.smoc.ai — our public website
- console.smoc.ai — operator dashboard (billing, contacts, inbox, analytics, settings)
- Studio — where you design, compose, theme, and publish agents and flows
- Bot runtime — live conversational delivery (web chat and card flows, embeds, and landing pages such as go2.smoc.ai)
- Message and outreach — for example LinkedIn message flows and connected sender accounts
- APIs, MCP, and other integrations you enable
You can run SMOC yourself, or we can help operate it for you. Managed work may have a separate order. These terms still apply to the platform.
2. We may change the software
We have the full right to change SMOC: features, models, channels, limits, and how it looks and works. We may add, improve, or retire parts of the service. We do not promise that any specific feature will stay available forever, and these terms are not an uptime or revenue SLA.
SMOC is provided as available. We may suspend or limit access for abuse, unpaid invoices (after a short grace window), or legal risk.
You are responsible for your account: accurate company and billing details, who you invite, and keeping login details safe. Activity under your account is yours.
3. Credits and prices
You buy a plan: access to the software plus a credit allotment for the billing period. You may also top up extra credits. Usage consumes credits at the rates shown on smoc.ai/pricing (and in Console) at the time you buy, renew, or use the service — or at the rates assigned to your company in Console.
We do not freeze prices inside this document. Changing the published catalogue is how we change price levels. New purchases and top-ups always use the live website at the moment you pay.
Included credits for a billing period reset at the end of that period unless the website says otherwise. Topped-up credits roll over if the website says they do.
If credits run out, billable work may pause until you top up, change plan, or receive the next allotment. Console stays available so you can manage billing and your data.
4. We may change prices with 30 days’ notice
We may change plan prices, credit rates, and included allotments. For an existing paid subscription, a change takes effect only after 30 days’ notice (email and/or in Console). If you do not want the new level, cancel before it starts.
5. You can leave whenever you want
There is no lock-in. Cancel in Console or by emailing us. Cancellation stops future charges. You keep access and entitlements until the end of the period you have already paid for.
Paid self-serve plans are ongoing subscriptions billed per the period shown at checkout. We do not cash out unused included credits or top-ups.
If a payment fails, we may keep the service running for a short grace window, then pause billable use until the invoice is paid.
6. How you use SMOC is your responsibility
You decide the campaigns, content, targeting, instructions, and audiences. That includes marketing and ePrivacy rules, consent, LinkedIn and other channel rules, what you put in Studio, and what you do with leads. We do not take responsibility for what you use SMOC for, or for the results you get.
SMOC uses AI models (ours and third parties’). They can be wrong. Output may be incomplete, outdated, biased, or made up. Agents may misread a prospect, pick a poor message, or take an action you would not. AI is assistive. You must review it before you rely on it, publish it, or send it to anyone. We do not warrant that models are accurate, or that they will behave as you expect.
Do not use SMOC to break the law, harm people, or abuse the service or third-party platforms. We may include links or connections to third parties (payments, identity, channels, models, CRMs). Those are their services, on their terms.
7. Limitation of liability
SMOC is provided as is and as available. We do not warrant that it will be uninterrupted, error-free, or that it will produce a particular number of leads or revenue.
We are not liable for campaign results, lost leads, lost profits, lost data, third-party platforms, AI mistakes or unexpected model behaviour, or your (or your end users’) misuse — including indirect, incidental, special, consequential, or punitive damages.
Our total liability for all claims relating to SMOC is limited to the fees you actually paid us in the twelve (12) months before the claim. This is a B2B contract. Rights that cannot be limited under mandatory Norwegian law still apply.
8. GDPR and the data model
The service is managed from Norway and delivered from within the EEA. GDPR applies. Our Privacy Policy is part of these terms.
| Data | Who is who |
|---|---|
| End-user, lead, conversation, and prospect data in your flows | You = controller. SMOC = processor. |
| Your team’s accounts, billing, and company settings | SMOC = controller (to run the SaaS). |
| Visitors to smoc.ai | SMOC = controller — see Privacy. |
You warrant that you have a lawful basis to upload personal data and to contact people. We use subprocessors as needed to run the service (hosting, auth, payments, models, channel connectors). A data processing agreement is available on request; Enterprise may sign one.
Privacy rights requests: [email protected].
9. Changes to these terms
We may update these terms. For material commercial changes we give notice in the same spirit as price changes. Continued use after the effective date means you accept the new terms. If you disagree, cancel.
10. Norwegian law
These terms are governed by Norwegian law. Disputes are handled by the ordinary Norwegian courts, with Oslo as the legal venue.
